Terms & Conditions of Use

1. Acceptance of Terms

These Terms of Service constitute a legal agreement governing your access to the cloud-based travel management software and all related services provided by GooManager LLC ("Company").

2. Service Description & Changes

GooManager is a SaaS (Software as a Service) platform offering operation, booking, and guide management tools for travel agencies.

2.1 Service Modifications

The Company reserves the right to develop, modify, or temporarily suspend platform features. Users will be notified in advance of critical changes.

2.2 Service Level Agreement (SLA)

We aim to maintain 99.9% server availability (uptime) on our standard plans. Maintenance work is carried out on a scheduled basis.

3. Account Registration & Security

A valid user account is required to access all features of the platform.

3.1 Registration Accuracy

It is your responsibility to ensure that the information you provide is current, accurate, and complete. Providing false information may result in account suspension.

3.2 Password Security

You are responsible for maintaining the confidentiality of your account password. You are directly responsible for all activity that occurs under your account.

4. Pricing & Payment Terms

Charges for our services are determined by the selected subscription plan.

4.1 Subscription Fees

Fees are collected upfront on a monthly or annual basis. The Company reserves the right to change its pricing policy; however, existing subscribers will not be affected until the end of their current period.

4.2 Payment Methods and Refunds

Payments are processed securely via Stripe using credit or debit cards. No partial or full refunds are issued after the initial 14-day trial and refund period has expired.

4.3 Tax Obligations

Unless otherwise stated, all prices are exclusive of applicable local taxes (Sales Tax, VAT, etc.). Tax amounts may be added to your invoice at the payment step in accordance with legal requirements.

5. Intellectual Property Rights

The code, design, logos, and entire infrastructure of the GooManager platform are the property of GooManager LLC and are protected by international copyright laws.

6. User Content & Data Ownership

All customer, reservation, and operations data you upload to the platform is entirely owned by you.

6.1 Data Processor Role

GooManager acts solely as a "Data Processor" for the data entered. The agency ("Data Controller") is fully responsible for obtaining the necessary legal permissions (GDPR, CCPA, etc.) for collecting and processing personal data belonging to passengers. The Company cannot be held liable for any legal issues arising from the unauthorized sharing of data.

7. Prohibited Uses

Using the platform in an unlawful, malicious, or infrastructure-damaging manner is strictly prohibited.

7.1 Anti-Spam Rules

The email and WhatsApp integrations within the system are intended solely for sending operational notifications (vouchers, pick-up times, etc.) to consenting customers. Using the platform to send bulk advertising, spam, or unauthorized marketing messages is strictly prohibited. In the event of a violation, the account will be immediately closed without any refund.

8. Suspension & Termination

The Company reserves the right to suspend or permanently close any account without prior notice in cases of serious violation of the terms of use, non-payment, or suspected fraud.

9. Limitation of Liability

GooManager services are provided on an "as is" basis. No guarantee is made that the platform will operate 100% uninterrupted or error-free.

9.1 Indirect Damages and Indemnification

GooManager LLC cannot be held liable for any loss of profit, missed operations/transfers, customer dissatisfaction, or any indirect damages arising from software errors, server outages, or data synchronization delays. Our maximum legal liability is limited to the subscription fee paid by the customer to the Company in the last 1 (one) month.

10. Governing Law & Jurisdiction

The laws of the United States and the state of Wyoming shall govern the interpretation and enforcement of these terms. Wyoming courts shall have jurisdiction over any disputes.
